West Side Boxing & Fitness Club – Indemnity Waiver
This Indemnity Waiver (“Waiver”) is entered into by the undersigned participant (the “Participant”) and, if applicable, the Participant’s parent or legal guardian, in favour of West Side Boxing and Fitness Club, its owners, directors, employees, contractors, volunteers, and agents (collectively, the “Club”).
1. Acknowledgment of Risks
I understand that participation in boxing, fitness training, and related activities involves inherent risks, dangers, and hazards, including but not limited to physical exertion, contact with other participants, use of equipment, slips, falls, and potential for serious injury or death. I freely accept and fully assume all such risks.
2. Release of Liability
In consideration of being permitted to participate in activities at the Club, I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby release, waive, and discharge the Club from any and all claims, demands, damages, costs, or causes of action arising out of any injury, loss, or damage that I may sustain while participating in Club activities, whether caused by negligence of the Club or otherwise.
3. Indemnification
I agree to indemnify and hold harmless the Club from any and all liability for any property damage, personal injury, or other loss to any third party resulting from my participation in Club activities.
4. Medical Fitness
I confirm that I am physically fit and have no medical condition that would prevent me from safely participating in Club activities. I consent to receive medical treatment deemed necessary if injured while participating and agree to be responsible for any related costs.
5. Minors
If the Participant is under 18 years of age, this Waiver must be signed by a parent or legal guardian. The undersigned parent or guardian acknowledges the risks, agrees to the terms of this Waiver on behalf of the minor Participant, and accepts full responsibility for the minor’s participation.
6. Governing Law
This Waiver shall be governed by and interpreted in accordance with the laws of the Province of Ontario.
7. Acknowledgment and Signature
I HAVE READ AND UNDERSTAND THIS WAIVER. I AM AWARE THAT BY SIGNING THIS DOCUMENT I AM WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. I SIGN THIS WAIVER FREELY AND VOLUNTARILY.
